Session Description

Now more than ever, employers must provide an inclusive environment to all employees. In the United States, federal, state and local legislatures and courts have endorsed increasingly greater protections based upon “gender identity or expression,” (i.e., protection against discrimination of “transgender” employees). As a result, employers must grapple with how best to accommodate transitioning employees (that is, how to accommodate employees who wish to present a gender different than that assigned at birth, how to address multiuse gender-specific restrooms, locker rooms and changing rooms and other similar issues).

This discussion will review the legal requirements and obligations of employers. Components of this presentation will include an overview of gender identity terms/classifications and discussion points on how to approach various gender identity issues in the workplace. Finally, the discussion will review tips for avoiding discriminatory behaviors and facilitating inclusiveness in the workplace by employers.

About the Speakers

Nancy Johnson

With a wide-ranging legal background, Nancy Johnson, Associate at Littler Orlando, skillfully advises and defends employers who are confronted by complex workplace challenges and the evolving labor and employment landscape. As a true business partner to her clients, Nancy works with in-house counsel through all phases of labor and employment litigation in state and federal courts and at the administrative agency level. Her targeted advice in the area of human resources reflects a strong combination of employment law knowledge and significant experience in other corporate legal matters, including bankruptcies, theft of trade secrets and qui tam actions relating to Medicaid and Medicare fraud.

Leveraging her previous experience as plaintiffs’ counsel, Nancy brings distinctive advantages to her defense of management-side clients. Additionally, she provides keen insights into workers’ issues based on the various companies where she worked before starting her law career.

Kimberly Doud

Kimberly J. Doud, Shareholder in Littler’s Orlando office, represents management in various aspects of labor and employment law, including representing employers in litigation of employment disputes including Title VII of the Civil Rights Act, the Fair Labor Standards Act (FLSA), the Family Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), and retaliation. Kimberly also provides employers with preventive counseling on day-to-day employment issues, including investigations, discipline, terminations, employee handbooks, and wage and hour compliance.

Prior to joining Littler, Kimberly practiced with a Florida-based law firm, representing employers in both the public and private sectors in all aspects of labor and employment law. During that time, she served as general employment counsel to the Greater Orlando Aviation Authority, representing the Authority in labor relations matters, including union organizing campaigns, elections, labor negotiations, grievances and unfair labor practice charges.
