Session Description

This discussion will review the various components of the Uniform Services Employment and Reemployment Rights Act (USERRA) and how to best manage reserve and National Guard  employees covered by the Act. During these challenging times, our nation’s Guardsmen and Reservists are answering the call to duty to protect the health and well-being of all Americans. We owe a duty to them to ensure full compliance by employers with the USERRA. Subjects to also include, benefits management when on military leave, “Status” of the employee upon return from employment, reserve drill and annual training requirements, the ESGR mediation process and how to work best with the mediator and lastly the reservist’s responsibility under USERRA.

 

Learning Objectives

          How ESGR can assist HR Hiring Managers with managing military Reserve and Guard Employees under the USERRA Law.

          To review some of the more prevalent violations of the USERRA Law and what employers can do to prevent and overcome them.

          What employers can do more to support their citizen soldiers and their spouses.

          Ways an employer can support their Guard and Reserve employees during the COVID-19 Pandemic.

          Methodologies available to employers who request an adjustment to an employee’s period of uniform service when the Service member’s absence imposes an adverse impact on the employer

          How to obtain verification of employee’s military service requirements of an employee’s uniformed service.

          How to overcome concerns regarding the timing, frequency and duration of military service.

          Learn the exemptions covered under the USERRA 5-year service limitation.

 


About the Speaker

Peter Caspari is the State of Florida Director of Employer Outreach for the Department of Defense, Employer Support of the Guard and Reserves, (ESGR) Agency. In his capacity, Mr. Caspari travels throughout the State of Florida speaking with employers about ways that they can support their citizen soldier employees who serve in the National Guard and Reserves.

As a community advocate Mr. Caspari has been actively involved in the support of our military service members, veterans and wounded heroes in many local and regional initiatives. He has been instrumental in establishing the local Broward County Chapter of the National "Our Community Salutes" initiative in the State of Florida to honor and recognize high school seniors who have volunteered to enlist in the military upon graduation and is the President of the Broward Chapter. Caspari has served as a member of the Board of Directors of Legal Aid Services of Broward and Coast to Coast Legal Aid. He is a recent Board member of the United Way of Broward County, Mission United Advisory Council, that provides services to our Veterans.

Caspari is the Chairman of the US Army Recruiting Battalion Miami Grassroots Outreach Program of Broward County. The mission of the program is to support Army values through the promotion of Army initiatives, outreach programs and enlistment opportunities. Caspari is the recipient of US Army Miami Recruiting Command “Volunteer of the Year” Award. Recently, Caspari was selected to the position of Community Advocate for the US Army Miami Recruiting Battalion.

Caspari is a honorably discharged, disabled Veteran from injuries sustained while serving in the US Air Force.

Mr. Caspari's passion as a community advocate with an eagerness to help and assist our service members, Wounded Heroes and Veterans is continually evolving. He believes in the philosophy that as a Community, the best way we can serve to support our military is through local citizen, grass-roots advocacy initiatives.
